01Acceptance of terms

By downloading, accessing or using the Service, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Service. These Terms also incorporate our Privacy Policy and Cookie Policy.

02The Service

IKTF uses image-recognition technology to help you identify famous and public figures from a photo you capture or upload, and to provide related information such as a name, the reason you may recognise them, and biographical details. We may add, change or remove features at any time.

03Eligibility & accounts

• You must be at least 13 years old (or the minimum age required in your country) to use the Service.
• If you create an account, you are responsible for keeping your credentials secure and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.

04Licence to use

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial use. You may not copy, modify, distribute, sell, lease, reverse-engineer or attempt to extract the source code of the Service except where permitted by law.

05Acceptable use

You agree not to use the Service to:

• Identify, profile, track, stalk or harass private individuals or anyone who is not a public figure;
• Breach anyone's privacy, data-protection or publicity rights;
• Engage in unlawful, fraudulent, discriminatory or harmful activity;
• Upload content you do not have the right to use, or content that is unlawful, infringing or offensive;
• Interfere with, disrupt or attempt to gain unauthorised access to the Service or its systems;
• Use the Service to make decisions that produce legal or similarly significant effects about a person.

We may suspend or terminate access if we reasonably believe you have breached this section.

06Accuracy of results

Recognition results are generated automatically and are provided on a best-effort basis for general information and entertainment. They may be incomplete, inaccurate or out of date. You should not rely on a result as a statement of fact or for any important decision, and you should independently verify information that matters to you.

07Subscriptions & payments

• The Service offers a free tier and may offer optional paid subscriptions or purchases.
• Payments, billing and renewals are handled by the Apple App Store or Google Play under their respective terms.
• Subscriptions renew automatically unless cancelled before the renewal date through your app-store account settings.
• Except where required by law or app-store policy, payments are non-refundable. Refund requests are managed by the relevant app store.

08Intellectual property

The Service, including its software, design, branding, text and graphics, is owned by or licensed to Flitzen Ltd and is protected by intellectual-property laws. The "IKTF" name and logo are our trade marks. Nothing in these Terms transfers any ownership rights to you. Information about public figures may be subject to third-party rights and is provided for reference only.

09Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free or secure.

10Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by negligence or for fraud. Subject to that, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, data or goodwill, arising from your use of the Service. Our total liability to you for any claim is limited to the amount you paid us for the Service in the 12 months before the claim, or £100, whichever is greater. Your statutory rights as a consumer are not affected.

11Indemnity

You agree to indemnify and hold harmless Flitzen Ltd and its officers, employees and partners from any claims, damages, losses or expenses (including reasonable legal fees) arising out of your misuse of the Service or your breach of these Terms or applicable law.

12Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, the licence granted to you ends, though provisions that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

13Governing law & jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that if you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts.

14Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you within the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.
